Building Service 32BJ Benefit Funds (referred to herein as “we,” or “us,” or “our,” or “Funds”) recognize that privacy of your information is important. When you use our services, visit or use our Websites or otherwise communicate with us (collectively, “Services”), we may collect and process certain information about you and your activities in relation to our Services, including information that may be considered “personal information” or “personal data” under applicable laws (“Information”).

What Information We Collect About You

We may collect Information from and about you, when you interact with our Services. The Information we collect may include:

Information you provide to us or we collect directly:

When you use our Services, we may collect certain Information from you. For example, when using certain areas of our Websites, you may be asked to provide or otherwise choose to provide us Information about you. We also may collect your Information through certain activities or transactions, such as completion of online forms, registration for accounts or other features (such as our online courses or scholarships), submission of a comment to one of our blogs, submission of a question using an “ask us” or similar feature, sending us an e-mail, submission of information through the employer self-service system, or communication with us in any other way.

  • Video and Audio Information: such as videos or CCTV recordings through our security cameras when you visit our office locations, video recordings and/or photographs of our events or conferences, audio recordings or voicemails you may leave us.
     
  • Other Information: any other information you may choose to provide, including information you provide when you communicate with us (e.g., contents of your email, text/SMS messages, voicemails, chat messages or other communications).
     

Information we automatically collect:

When you use or interact with our Websites or interact with our email communications, we may automatically collect certain Information about you and your devices through the use of cookies or other tracking technologies, including:

  • Device Information: such as your browser type, device ID and type of device you are using and its display settings, your operating system, session start/stop time, time zone and network connection type (e.g., Wi-Fi, cellular).
     
  • Internet or Other Electronic network Activity Information: such as your internet protocol (IP) address, unique identifiers, and other information regarding your interaction with our Services.

We may receive Information about you through third parties or supplement the information obtained from or about our you with information that we receive or otherwise obtain from third parties. For example, we may receive Information about you from your union, affiliated funds and our third-party service providers that perform services for us or on our behalf. We also may receive Information about you from publicly available sources, such as any comments, content or details that you post on publicly available websites or social media platforms, including any information that accompanies those posts, such as your name, username, email address, your likes or preferences, or profile picture, subject to your privacy settings on these platforms and/or websites.

Cookies and Other Tracking Technologies :

We and our third-party service providers on our behalf may use tracking technologies, such as cookies, web beacons or pixels to track your usage and interactions with our Websites. We (or our third-party service providers on our behalf) may also use such tracking technologies in our email communications with you to help us verify if you viewed or interacted with our email communications. Cookies are small pieces of script or code that automatically get stored on your browser or device when you interact with our Websites or our email communications and collect information about you and your browser or device. We may use the information collected through cookies to administer, monitor, and improve our Websites, and to personalize your experience with our Websites or email communications. To the extent you elect to submit other information through the Website (e.g., email address or login credentials), Heap may also collect that information on our behalf. The data and information that Heap collects will be used by us for various purposes, including to improve our Websites and our users’ experience with them, and for Heap and our other service providers to provide services to us and support to the Website and our users. Depending on the type of Web browser you have, you may be able to opt-out of having certain of your web usage information sent to Heap by adjusting the settings on your Web browser.

  • Provision of Services: We use your Information for the provision of our Services, including the provision of benefits to our members (including their dependents and beneficiaries), administer and maintain our benefit plans and member accounts, administer our courses and other offerings made available under our scholarship fund, the maintenance, management and administration of our Websites, including technical or other support to resolve technical issues, and provision of a customized experience (for example, by remembering choices you make when you use our Websites, and to enable you to register for any account with us).
     
  • Communications: We use your Information to communicate with you, including responses to your requests, answers to your questions, and notices (in the form of e-mails, mailings, and the like) about your accounts, benefits, plans, and programs in which you may be participating.
     
  • Marketing and Advertising Purposes: We may use your Information to send you promotional materials and/or market or advertise our benefits and programs to you.
     
  • Improvement of our Services: We may analyze your Information for purposes of increasing the functionality and user-friendliness of our Websites (e.g., better tailor the Websites to our users’ needs).

  • Affiliated Benefit Funds: we share your Information with our affiliated funds in connection with any of the uses of your Information set out in this Notice.
     
  • Service Providers: We may share your Information with our third-party service providers, such as server hosts, data management companies, address list hosting companies, e-mail service providers, analytics companies, distribution companies, fulfillment companies, and payment processors (collectively, “Service Providers”), who may use such information on our behalf to facilitate the operation of our Services, including our Websites and programs.
     
  • Your Union: We periodically share your Information, such as your account and profile information, with your union.
     
  • Public Forums: When you contribute to or post to publicly available features of our Websites, such as our blog or other public forums available on our Websites, the information that you submit, or post will be made available to the general public. For this reason, we recommend that you do not submit in these areas of the Websites any sensitive information, such as any financial information or any information you do not wish to be made publicly available.

  • Texts/SMS Messages: If you consent and subscribe to our text message program, you will receive text/SMS messages from us about benefits and programs.
